What to expect during a newborn session…

We are thrilled you are expecting and have inquired about our newborn photography session! Below is a little more information about the session and a few FAQs. If you have any other questions or would like to book at session please fill out the contact form!

Newborn photography session is $500. A 50% non-refundable retainer is required to book a session along with a signed contract. We accept Venmo as a form of payment. Other arrangements such as cash or a personal check is accepted as well. Final payment of remaining balance is due day of photoshoot. 

How does scheduling a session work with a newborn? 

Newborn sessions are tentatively scheduled. Once the contract and retainer have been received we will set up a newborn session a few days following your due date. No worries if baby has other plans and arrives earlier or later! That is why we schedule tentatively.  Once baby is born you email us and we set a date for the session.  Most sessions will being around 10a.m. For scheduled C-sections we schedule an exact date. The session must be done within the first 7 -10days of birth.  So it’s super important you email us right away! This allows for the best molded shots. After the first week baby is more alert and that makes it a bit more challenging to get those molded shots.  You may not get those molded shots if we come after the first 10 days. We will certainly try, but if baby is not having it the session becomes more of a lifestyle shoot. 

Where is the session held? 

We come to you! If you are within the Ventura County limits we come to your home at no extra charge. If you are reside out of Ventura County we add a travel fee. Depending on where you live will depend on travel fee. 

How long is the newborn session? 

The photo session can last anywhere from 1-3 hours. It just depends on how your little one is doing. We are mamas too so we understand baby needs to eat and have diaper changes and sometimes just need a little snuggle session. 

What sort of props do you have? 

We will bring the following props: headbands, swaddles (assorted colors), baskets, bean bag, blankets. If there is a particular outfit you’d like to put your baby in you are more than welcome to do that! 

What is inclusive of a Newborn Session? 

Newborn sessions are $500. A newborn session includes a minimum of two posed shots as well as lifestyle shots that include siblings and parents. You will receive an online gallery with a minimum of 35 edited and print ready images. 4-6 weeks from photo session date.

EXAMPLE CONTRACT:

This Agreement is made effective for all purposes in all respects as of (1.1.2019) by and between CALI + HI PHOTOGRAPHY, hereinafter referred to as “CALI+HI PHOTOGRAPHY" and Client name , hereinafter referred to as "The CLIENT" relating to the event(s) detailed below, hereinafter referred to as "The EVENT(S).

ENTIRE AGREEMENT: This agreement contains the entire understanding between CALI+HI PHOTOGRAPHY and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable.  Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

RESERVATION: A signed contract and a 50% non-refundable retainer are required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the CLIENT, the retainer fee is non-refundable and shall be liquidated damages to CALI+HI PHOTOGRAPHY. The CLIENT shall also be responsible for payment for any of CALI+HI PHOTOGRAPHY’S material charges incurred up to time of cancellation.

EVENT SCHEDULE: The client agrees to confirm the schedule one-week prior to the EVENT(S).  Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from CALI+HI PHOTOGRAPHY by the CLIENT.

SAFETY: CALI+HI PHOTOGRAPHY reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from CALI+HI PHOTOGRAPHY experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or in the event that the safety of the photographer from CALI+HI PHOTOGRAPHY is in question.

SHOOTING TIME / ADDITIONS: The CLIENT and the CALI+HI PHOTOGRAPHY agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time.  If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time.  All additional time beyond the scheduled end time will be billed to the CLIENT.

EXPENSES INCURRED: When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs unless provided by the CLIENT.

TRAVEL EXPENSES:  All travel expenses are based on the distance between the EVENT location(s) and CALI+HI PHOTOGRAPHY mailing address.  For all EVENT(S), the first _25_ miles roundtrip  of travel are included.  All miles in excess of __50__ miles roundtrip are charged at $__.60____ per mile. 

RESPONSIBILITIES:  CALI+HI PHOTOGRAPHY is not responsible for compromised coverage due to causes beyond the control of CALI+HI PHOTOGRAPHY including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to CALI+HI PHOTOGRAPHY, rendering of decorations, or restrictions of the locations. CALI+HI PHOTOGRAPHY is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. CALI+HI PHOTOGRAPHY is not held liable for missed coverage of any part of the EVENT(S).  CALI+HI PHOTOGRAPHY will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).

VENUE AND LOCATION LIMITATIONS: CALI+HI PHOTOGRAPHY is limited by the rules and guidelines of the location(s) and site management (if applicable). The CLIENT agrees to accept the technical/lighting results of their imposition on CALI+HI PHOTOGRAPHY. Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility; CALI+HI PHOTOGRAPHY will offer technical recommendations only.

FILM and COPYRIGHTS: The photographs produced by CALI+HI PHOTOGRAPHY are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without CALI+HI PHOTOGRAPHY'S explicit written permission. If the CLIENT has purchased digital images and/or if digital images are included in photography package, upon final payment by the CLIENT, limited copyright ownership of the resulting images will be transferred to the CLIENT.  If the CLIENT has purchased and/or if digital images are included in photography package from CALI+HI PHOTOGRAPHY, CALI+HI PHOTOGRAPHY grants the CLIENT permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to CALI+HI PHOTOGRAPHY. The CLIENT must obtain written permission from CALI+HI PHOTOGRAPHY prior to publishing or selling the photographs.  
 
MODEL RELEASE:  The CLIENT hereby assigns CALI+HI PHOTOGRAPHY the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction.  The CLIENT releases all claim to profits that may arise from use of images.

CALI+HI PHOTOGRAPHY reserves the right to use all photographs in any manner to promote and market CALI+HI PHOTOGRAPHY. This includes but not limited to sharing on social media, websites and print. CALI+HI PHOTOGRAPHY reserves the right to post or share at anytime. For an example you may see a sneak peak of your photo session on social media before your gallery has been delivered.  This is our way of promoting our products. We have the right to do so because we own the rights of the photographs. If you DO NOT want your photographs shared and or posted on social media you have the option of buying limited rights to the photographs. Please contact us for any questions.  

***In circumstances where The CLIENT does not want any images posted or shared via  websites, social media, print (marketing and promotion decided by CALI + HI PHOTOGRAPHY), The CLIENT has the option to pay a premium of $300 in which the gallery photos will not be published on CALI + HI PHOTOGRAPHY’S website or social media accounts nor will it be used for marketing or promotion of CALI + HI PHOTOGRAPHY.**

**In circumstances in which The CLIENT wants first viewing rights. The CLIENT will pay a premium of $300. If premium is paid The CLIENT will have first viewing rights before any photos are posted on CALI + HI PHOTOGRAPHY’S website or social media sites. **

LIMIT OF LIABILITY: In the unlikely event that the assigned photographer from CALI+HI PHOTOGRAPHY is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of CALI+HI PHOTOGRAPHY, CALI+HI PHOTOGRAPHY will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S). 

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond CALI+HI PHOTOGRAPHY’s control, including but not limited to camera, hard drive, or equipment malfunction,  CALI+HI PHOTOGRAPHY liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.  CALI+HI PHOTOGRAPHY is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package. CALI +HI will keep jpegs of  the session for a total of 3 months from delivery date.  The CLIENT is responsible to download the gallery within that time frame. It is highly recommended that The CLIENT download the gallery within the first week of delivery. After a week the link will expire and a new one will have to be created. If this happens email CALI+HI PHOTOGRAPHY and a new link will be generated.  

WAIVER OF LIABILITY RELEASE By agreeing to a photography session with CALI + HI PHOTOGRAPHY, I am hereby waiving, releasing, and discharging CALI +HI PHOTOGRAPHY and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. CALI + HI PHOTOGRAPHY is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.  CALI +HI PHOTOGRAPHY is not responsible for children or clients who do not want to participate in the photo session. We do our very best to engage little ones. The CLIENT swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against KAITE CHATELAIN , BECKIE KEARNS CALI +HI PHOTOGRAPHY  for any reason. 

CAPTURE AND DELIVERY:  CALI+HI PHOTOGRAPHY is not liable to deliver every image taken at the event.  The determination of images delivered to the CLIENT is left to the discretion of CALI+HI PHOTOGRAPHY. 

POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the CALI+HI PHOTOGRAPHY. 

PAYMENT SCHEDULE: The aforementioned __50__% non-refundable retainer fee is due at the time of signing of agreement. The remaining balance is DUE IN FULL DAY OF PHOTOSHOOT. In the event the CLIENT fails to remit payment as specified, CALI+HI PHOTOGRAPHY shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S). Returned checks will be assessed a $__100__ non-sufficient funds fee.

PRICING: Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward merchandise purchased from CALI+HI PHOTOGRAPHY.

Your online gallery will be delivered 4-6 weeks from the newborn session date. You will receive a minimum of 35 images, edited and print ready. You will be notified via email. Please ensure we have correct email. If you prefer another email than what we have listed for gallery to be sent please notify us.
